Safe Harbor Data Privacy Notice
NLX abides by the European Union ("EU") Safe Harbor Framework Rules for safeguarding the privacy of data moving from the EU to the US. This component of our Privacy Policy shapes our fundamental policy and procedures for applying the Safe Harbor Rules, inclusive of the kind of data to which this notice applies, how we use personal information, and also the choices individuals have concerning our use of, and their opportunity to correct, that personal information. International Customers

In these agreements, the EU client agrees and recognizes that it's the "data controller" for the purposes of data protection legislation. This means that our EU clients are responsible for complying with the data protection legislation within the applicable Member State before they send out their customer information to NLX for processing. Any information processed by NLX is only disclosed to third parties with the request and direction of its EU clients as the data controllers, or when required by law. Any material which our EU customers identify as private shall be treated as such.

Sensitive Information
"Sensitive information" is a subcategory of personal information. Sensitive information is defined as personal data indicating clinical or health conditions, racial or ethnic origin, personal politics, religious or philosophical beliefs, trade union association, and/or sexual conduct of the particular person. Sensitive information also entails personal data received from a third party where the third party treats and identifies it as sensitive.

Disclosure
We will comply with the Safe Harbor Principles in regard to disclosures of sensitive information, including, if applicable, acquiring the person's express permission in advance of disclosing sensitive information to a 3rd party or using sensitive information for purposes other than those for which it was originally collected or subsequently authorized by the individual. Transfers of data acceptable under this notice, either to 3rd parties or within NLX, include the transfer of information from one jurisdiction to another, such as transfers to and from the US. NLX will take reasonable safeguards to secure personal data in its possession from loss, improper use and unauthorized access, disclosure, modification and destruction. NLX conducts compliance audits of its relevant privacy practices to ensure adherence to this Policy. Any staff member that NLX determines is in violation of this policy will be subject to disciplinary measures up to and including immediate termination of employment.

Chief Privacy Director
NLX has a Chief Compliance Officer responsible for the internal supervision of NLX privacy policies. NLX trains its employees about compliance with the Safe Harbor Principles and has self-assessment procedures set up to enforce compliance.

Dispute Resolution
NLX is a member of the Direct Marketing Association (DMA) Safe Harbor dispute resolution process. If an individual feels this organization is not following its posted policies or isn't in compliance with the Safe Harbor principals, he or she should contact NLX's Compliance Director by email at privacy@NLX.net. If the individual does not receive acknowledgment of his / her inquiry or the inquiry isn't satisfactorily addressed, the individual should then call the DMA Safe Harbor Dispute Resolution Program. Disclosures and Transfers
NLX does not disclose personal information to 3rd parties, except when one or more of the following conditions are met: (i) We have the individual's authorization to allow the disclosure;
(ii) The disclosure is acceptable by law or mandatory professional conditions;
(iii) The disclosure is reasonably related to the sale or other transfer of all or part of our company or assets;
(iv) The personal information to be shared is publicly available;
(v) The party to whom the disclosure is made controls, is controlled by, or is under common management with NLX;
(vi) The disclosure is reasonably necessary for the establishment or maintenance of legal claims; or
(vii) The disclosure is to individuals or entities for which we are providing professional services, provided the disclosure is consistent with the function for which the personal information was received.

It is possible that as we continue to grow our organization, NLX may be sold. Given the event of such a a deal, customer information may be transferred to the acquiring company. If, as a result of the business transition, the users' personally identifiable data will be used in a manner materially different from that stated at the time of collection, the user will be provided choices consistent with our notification-of-changes segment .

Links to other internet sites
NLX's web sites, or electronic messages created with NLX Solutions, may incorporate hyperlinks to other internet sites. NLX is not accountable for the personal privacy practices or the content of these various other web sites. Third parties may separately gather data about internet sites visitors as they read ads or other marketing communications from third parties via NLX systems or services. If visitors do not wish those companies to obtain data about them, they should contact these companies directly.

Modifications to this Policy
NLX will notify its Customers and subscribers by way of email if we make any alterations to our Privacy Policy. Any new policy will be posted on our site at least thirty (30) days before its taking affect. If at any point we elect to use personally identifiable information in a fashion different from that stated at the time it was collected, we will notify impacted members via email. Subscribers will have a choice as to whether or not we use their information in this different manner.
